Our community and our criminal justice system is plagued with a growing number of domestic violence cases that end up in our Superior Court.
The California Legislature has made the prosecution of these types of cases a real priority and has provided special funding allowing vertical prosecution and has provided victim advocates and investigators to help ensure the successful prosecution of domestic violence defendants.
These measures along with the public and the Court’s keen awareness of this growing problem makes for aggressive prosecution against anyone accused of Domestic Violence charges. Hence you need a savvy and aggressive attorney who has the requisite experience and skill to successfully defend you against the prosecution machine if you are so unfortunate to have been charged with a domestic violence count.
Attorney Justin Milligan just recently got our client a jury acquittal on a serious domestic violence allegation that went to trial for over a week. Don’t risk going to jail or worse.
Here is an example of an recent arrest that was widely broadcasted to the public by the Santa Rosa Police Department—Don’t you fall victim to false or trumped up charges, LAWYER-UP with us:
On March 10th, 2016 at about 7:45pm, the Santa Rosa Police Department received a report of a family disturbance occurring at the Pioneer Apartments at 2028 Piner Rd.
As officers arrived on scene, they met with a female resident who stated that she had just been assaulted by her boyfriend, identified as Jesus Banda-Marin (24ys). Banda-Marin had fled on foot when the police had been called to the residence.
As the patrol officers conducted their investigation, Banda-Marin returned to the apartment. When the officers tried to speak with him, Banda-Marin again fled on foot. Officers pursued Banda-Marin through the adjoining neighborhood and then westbound through Pioneer Park. A perimeter was established and the officers believed Banda-Marin was hiding in the area of Red Oak Ct and Peterson Ln.
Officer Pena and his K-9 partner, Hoss, joined the search of the area. Banda-Marin was located hiding on the front porch of a residence on Red Oak Ct. Officer Pena’s K-9, Hoss, alerted to Banda-Marin’s location and Officer Pena ordered Banda-Marin to surrender.
When Banda-Marin continually failed to comply with the commands, Officer Pena deployed his K-9, Hoss, who subsequently bit Banda-Marin in his left calf. Officers were then able to safely take Banda-Marin into custody.
Banda-Marin was transported to a local hospital where he was treated for the dog bite and then booked into the Sonoma County Jail on the following charges:
273.5 PC Felony Domestic Assault
1203.2 PC Violation of Probation
148(a)(1)PC Obstruction
The above-mentioned Felony charges are serious and a conviction could adversely affect the rest of your life since felony convictions call for long jail or prison sentences, stiff fines and cause substantial damage to your ability to get a professional license, earn a decent living and in some cases prevent you from receiving government aid, housing or education loans.
A felony conviction oftentimes carries other burdens like the inability to vote, serve on juries, and to own or possess guns and firearms!
